Alternative dispute resolution (ADR) allows the parties to discuss their issues in an open environment. The benefits of ADR include:
- Parties can reach their own decisions regarding rather than leaving it up to a judge or jury
- Resolving disputes through ADR often costs less than pursuing a full trial and usually takes less time
- The decisions made during mediation, arbitration or other ADR methods create win-win situations. There is no winner or loser.
- Resolving one dispute through ADR sets a precedent for resolving future legal disputes amicably
Types of Alternative Dispute Resolution Methods
Two of the most common ADR methods are mediation and arbitration. During mediation, the discussion is guided by a neutral mediator. The mediator may facilitate settlements through negotiations, but makes no decision regarding the final agreement. In arbitration, a third-party ¾ usually a lawyer or retired judge ¾ listens to the arguments of both parties and makes the ultimate decision based on the evidence presented. The final decision is binding and cannot easily be disputed in court.
